This is the second position paper i presented at MEXMUN 2008 SC on english too.

The situation in Somalia is grave. It poses a real threat to peace and security in the Horn of Africa and is causing terrible suffering among the Somali population. The situation requires an integrated approach on the part of the international community to address all the various aspects of the crisis. In that context, I thank Special Representative Mr. Ould Abdallah for his detailed report on the latest developments in that country and for his recommendations for strengthening the action of the international community. I also thank the representative of Somalia for his contribution to the debate.
At the political level, the appointment of the new Prime Minister, Mr. Nur Hassan Hussein, has opened a new window of opportunity for progress in the transition process. We encourage the Prime Minister to invite all political forces, inside Somalia or out, that renounce violence and accept the Transitional Federal Charter as the framework for the restoration of peace in Somalia to participate in an inclusive political process. The Transitional Federal Government is primarily responsible for implementing the conclusions of the National Reconciliation Congress and for establishing a road map for completing the transitional period. That includes preparations for a constitutional referendum and for elections by 2009, in accordance with the Transitional Federal Charter.
The humanitarian situation continues to deteriorate, as the Under-Secretary-General for Humanitarian Affairs, Mr. Holmes, recently reminded the Council. There is no indication that this trend will reverse itself. The urgency of the crisis has even prompted dozens of non-governmental organizations to appeal to the international community. A growing portion of the population is dependent on assistance, which, however, is facing serious problems of access. All parties, and the Transitional Federal Institutions in particular, are duty-bound to protect the population, respect international humanitarian law, facilitate access to those in need, and promote the return of displaced persons to their areas of origin.
Incidents similar to that of 4 December, when the closure of land and maritime access points to humanitarian assistance was announced and subsequently retracted, must absolutely be avoided. We must also find a speedy solution, together with the Somali authorities, to the thorny problem of people being made to pay for the right to cross checkpoints. We expect the new Prime Minister to reaffirm his Government’s commitment to the facilitation of humanitarian assistance and to do all in his power to end impunity in the country.
The essential prerequisite for lasting improvement, however, remains the stabilization of security. All parties are duty-bound to put an immediate end to acts of violence and to implement a ceasefire that will allow the launching of a genuine political process. Belgium endorses the Secretary-General’s analysis that the dispatch of a peacekeeping force cannot be envisaged in the current circumstances. The African Union Mission in Somalia (AMISOM) remains the sole available option for facilitating the withdrawal of foreign forces from that country. Belgium expresses its support for AMISOM and for the countries that contribute to it. We reiterate the need to strengthen AMISOM, particularly in financial terms, and encourage the United Nations, in cooperation with the African Union, to consider new forms of support for that force, be it in technical assistance or the design of operations, and to implement them post-haste. Belgium is also committed to that approach.
We are well aware that the United Nations has a responsibility to protect with respect to the people of Somalia and has to maintain its credibility in the eyes of international public opinion. Belgium therefore fully supports the efforts of the Secretary-General and Mr. Ould Abdallah to increase the coordination of international activities in Somalia by developing a comprehensive plan of action, in particular in support of the transition process and the security sector in Somalia. We especially support the Secretary-General’s recommendation that the United Nations Political Office for Somalia be strengthened. We are also willing to listen to those who propose feasible and appropriate solutions to halting the cycle of violence and to stemming the crisis in Somalia, convinced that the international community must pursue and increase its commitment to that course.

Under the Charter of the United Nations, Belgium has the obligation to act on behalf of the international community and therefore to defend global interests first and foremost. But it will fulfil this responsibility from a Belgian and European perspective. This membership, which follows on from our presidency of the OSCE in 2006, is a new expression of our multilateral engagement.
Being a non-permanent member is not a power which one assumes but an authority which must be built up on the basis of intensive, high-quality work. Belgium will also attempt to make the most of its traditional role of conciliator, with pragmatism and common sense.
The presence of five EU members on the Security Council (United Kingdom, France, Belgium, Italy and Slovakia) creates a significant potential. With the four other EU members in the Security Council, Belgium will revive coordination amongst them and will try to create more consistency between the debates in the EU and those in the Security Council. We will do this in a pragmatic fashion, by focusing on the results when we feel there is added value to contribute and the maneuvering room to do so.
As Minister De Gucht put it: "Being part of the Security Council gives Belgium a central role to play on the international scene. The task of the Security Council is to manage crises around the world. To me it serves as something of a global 'core cabinet'. The issues it discusses concern 'high-risk' countries from the security point of view, like Sudan, Congo or Lebanon, as well as global matters like the spread of weapons of mass destruction or the recruitment of child soldiers".
"I intend to focus my own energy and the efforts of my diplomats on working to make the world a safer place, without any misplaced pretensions. As the Charter stipulates, whilst exercising this mandate, we will first and foremost take on board the interests of the international community. However, we must also adopt a European viewpoint, which will entail close dialogue with those of our EU partners who are on the Security Council at the same time as Belgium", the minister added.
The downfall of the Soviet Union in 1991 gave independence to 15 new countries. Since then, three of these (Estonia, Latvia and Lithuania) have joined the EU and NATO. The 12 remaining countries constitute the Commonwealth of Independent States, or CIS. Russia, which remains the largest country in the world in terms of its surface area, even after the disappearance of the USSR, has become a member of the G8 and enjoys privileged relations with the EU and NATO. Following the recent enlargement, the Union's external border shifted east. European neighbourhood policy, an initiative taken by the EU in 2004, is strengthening links with Ukraine, the Republic of Moldova, Armenia, Georgia and Azerbaijan.
Belgium unreservedly condemns the unilateral decision of the Russian Federation to recognize the independence of South Ossetia and Abkhazia. That, as we see it, is an act that is based on no legal framework. It violates the territorial integrity of Georgia and goes against all the principles of international law that govern international relations. It contravenes United Nations resolutions, in particular resolution 1808 (2008), adopted unanimously as recently as last April. Finally, it also runs counter to the Helsinki Final Act.
As was stated by the Secretary-General in his declaration of 26 August, Belgium fears that the Russian decision may have serious negative implications for security and stability in the region. Belgium reaffirms its unconditional support for the territorial integrity of Georgia within its internationally recognized borders and calls on the Russian Federation to reverse its decision.
Secondly, Belgium continues to advocate for a full implementation of the six-point peace plan with respect for the additional clarifications embodied in the exchange of letters between French President Sarkozy and Georgian President Saakashvili. The continued presence of Russian troops on Georgian territory outside of the borders established by the six-point accord and its clarifications, particularly, for example, in the port of Poti area, constitute a violation of the accord.
Thirdly, my delegation also regrets the fact that the Security Council has not yet been able to take a unified stand on the conflict in Georgia, notwithstanding the efforts of the French delegation, among others, to whom my delegation wishes to express its deep appreciation. It is clear that the international community, and among others, the United Nations, the Organization for Security and Cooperation in Europe (OSCE) and the European Union, have a critical role to play in stabilizing the region. In this context, it is up to the Security Council to draw up the framework for the implementation of an international mechanism embodied in the six-point accord. The Russian decision to recognize South Ossetia and Abkhazia is not one to facilitate finding the necessary consensus.
Finally, Belgium is seriously concerned with respect to the humanitarian situation. We note that reports indicate grave violence and destruction of villages that have traditionally important Georgian majorities within the conflict zone. This situation needs to be properly investigated, as appropriate, by a United Nations fact-finding mission. In this context, we would once again stress the need for free humanitarian access to all the areas touched by conflict and the immediate establishment of conditions that will make it possible for refugees who have fled to return home.
